Se remitió el expediente de tutela al Tribunal Contencioso Administrativo de Cundinamarca, Sección Segunda, Subsección A, para que adelante la correspondiente actuación judicial.
La Corte Constitucional encontró que para el caso en concreto se hace necesario aplicar el Art. 37 del Decreto 2591 de 1991 consagra que “son competentes para conocer de la acción de tutela, a prevención, los jueces o tribunales con jurisdicción en el lugar donde ocurriere la violación o la amenaza que motivaren la presentación de la solicitud”.
Tal aplicación se hace necesaria puesto que hasta la fecha todo asunto asumido por el Consejo Superior de la Judicatura, incluyendo la acción de tutela, viene siendo conocido por la Sala Disciplinaria en pleno.
En consecuencia, las decisiones de ésta se quedarían sin segunda instancia.
